In fact, more homeowners are renting out  homes that they could not sell, than homeowners that are actually  putting their house on the market. If you are contemplating making this  move then I want to give you an alternative to renting out your house  and my reasoning behind the alternative.</p>
<p>When you rent out your  house, you are forced to deal with a few things that you probably don&#8217;t  want to deal with. For example, when you rent out a home you are  responsible for repairs on that property even if the tenant causes the  damage. Unless you are set up to make repairs on a property regularly,  then you might want to consider doing something else.</p>
<p>Second, when  renting a property, you are also forced to collect rent and in some  cases deal with evictions. These two processes can be very strenuous and  tiring to an unfamiliar property owner. Finally, when becoming an  unexpected property owner, it is easy to miscalculate expenses and end  up paying money to rent out your home instead of profiting from it. I  have seen this happen to many unexpected landlord&#8217;s because they did not  realize some of the other fees that they would pay such as vacancy  expense, landlord licensing (in some areas), and cleanup costs.</p>
<p>So  the alternative to dealing with all of these issues is to either become  a management expert or to do it a better way. Consider selling your  home under a rent to own agreement. Renting to own will relieve many of  the issues that a property owner has to deal with. No property repairs,  no cleanup costs, and you can secure your sales price with your tenant  as a potential buyer. You can also let a company rent your house for  you. A small apartment can be  comfortable to a couple as a 4-bedroom or a duplex fits so well to a  family of three.</p>
<p><em>Space</em> &#8211; Each person requires space. Some people  don&#8217;t actually like larger spaces, while some do. The space might not  just be the simple measurements of the house itself, but also of the  surrounding land or the whole real estate property.</p>
<p>An environment  points to the setting or situation of a locale. For example, a city  sprawling with thousands upon thousands of people with huge towering  skyscrapers is a metropolitan environment. Still, there are countryside  environments and industrial environments that are still prevalent in  this world. Where you want to live is a point to think about. It might  be just for the comfort of being near your workplace, or it can be for  the peace of mind, knowing that where you are living is safe and far  away from all the clashes of the modern world.</p>
<p>Almost all people  work to live. And sometimes or most, our work is not where we originally  live. So it becomes a point to move out to wherever our work brings us.  Sometimes it might be for the good of everything, but sometimes it is  just for the necessary point of living.</p>
<p><em>People</em> &#8211; People choose to  move into certain locations, because of other people. There can be  myriads of reasons for this kind of move. A person might be moving  because another person of note is at that location. Or it can be the  other way around, where a person is there that is why the other person  is leaving.</p>
<p>For whatever reason a person moves, the location still  matters, because it will be the one that dictates if that move will be  permanent or not. Or another move might be just around the corner.</p>

<p>It&#8217;s probably fair to  say that estate agents or realtors are viewed pretty dimly in some  quarters. Indeed, I have, and only recently, come across some charlies  in very sharp (and might I say tight) suits looking suspiciously like  they wanted to sell me the Eiffel Tower. Not the kind of people you  would welcome with open arms into your family home and proudly show off  the silverware to. And there&#8217;s the problem: When someone calls me you  can sense the suspicion down the line. &#8220;Where&#8217;s the catch?&#8221; is the  unspoken question squeezing itself between all the spoken ones. Even  worse when you arrange to meet and you can actually see their sceptical  thoughts forming over their heads in bouncy speech bubbles.</p>
<p>Property  buying agents probably know the market much better than you. It&#8217;s true,  you&#8217;ve probably been on holiday to Venice or Lake Como or Siena or  whatever far more often than we have. But were you actually conducting  an in-depth, from the inside out, study of the property market or just  sunbathing? And not only, while you were on holiday in, say, the  province of Siena, were you simultaneously in the province of Florence,  Pisa or down in Maremma? Probably not. And if you were, do you know how  those areas compare to places in, say, the colline piacentine, both in  terms of price and property typology (and weather)? Doubtful. So,  there&#8217;s one serious advantage of retaining a property buying agent; they  should be able to give you good info on not just your area of choice  (and property of choice), but also other comparable areas you may never  have even heard of, but could, ultimately be better for your  requirements.</p>
<p>Another big plus is the time we save the client. To  illustrate; some dear gentlemen a few years ago requested a country  property, and it had to be &#8217;silent&#8217; but within easy reach of at least  one international airport. (Sometimes, you really do feel like you&#8217;ve  accidentally taken the same drugs Alice in Wonderland inadvertently took  and ended up at the Mad Hatter&#8217;s tea party &#8211; I mean, honestly.) How  many properties do you think we viewed on behalf of this client, not  just to make sure they were beautiful country homes falling within the  search brief requirements, but that also if you stayed there for any  length of time, they would be silent enough? But, eventually we did find  enough to organise a viewing trip with the client. How much time do you  think we saved this guy by visiting a never ending list of properties,  sometimes several times, before we selected 4 which we deemed worthy of  bring him to? So, that&#8217;s big plus number two: property buying agents  save you lots of precious time.</p>
<p>Here&#8217;s the third reason:You&#8217;re retaining someone with a more in depth understanding of the buying process than yourself.</p>
<p>To  illustrate: While perusing the documentation for a rather large country  house with 18 ha of garden, olive groves, vineyards, pastures and  woodland attached, our architect noticed a small anomaly in the <em>visura</em>. The <em>visura</em> is one of the documents issued by the Italian Land Registry which  details the property and land and is the basis to calculate taxes due  when purchasing. The house was built on the ruins of an old <em>podere</em>, much enlarged and boasting enormous picture windows (all the better for enjoying the views of the private valley). The <em>visura</em> said this luxury home was still a farm building. Now, honestly, how many poor old Tuscan <em>contadini</em> with their trousers tied up with string are going to spend their  afternoons on sun loungers by an Olympic-size pool, surrounded by  beautiful girls in bikinis, sipping on Pina Coladas? We thought probably  not many. But, technically, as a farm shed the house had no tax  liability. So, somebody was being imaginative &#8211; and it wasn&#8217;t the sheep.</p>
<p>The  suspicion was that when the new house was put up, to avoid or at least  postpone the day when taxes had to be paid on what was now a large  residential property and not a shed, a little deal had been done with  the local town authorities. Surprisingly, the estate agent said not a  word, but the matter was examined by our lawyers and architect. Why?  Because upon sale the new owners, the clients we were representing, may  well have found themselves on the wrong end of a hefty property tax  bill. But who would have said ahead of time if not someone retained to  act wholly in the interests of the buyer.</p>
<p>Here&#8217;s another story; an  estate agent I know, working for a respectable international outfit,  had a particular property on the books, sat, unfortunately (unless  you&#8217;re a plane spotter) bang under a flight path. However, this rather  astute character would only take clients to view when there was a gap in  flights of about 40 minutes, which occurred early afternoon. And why  not? The argument was, they&#8217;d been retained by the seller to sell and  that&#8217;s just what they were doing&#8230;</p>
<p>We too have done our fair  share of plane spotting, but, as a rule, in an effort to forewarn the  prospective buyer. I&#8217;ve also spent time in hedges listening to the road,  counting how many trucks pass, if the innocent looking building down in  the valley emits industrial noises after lunch and lots of other odd  things that drive estate agents mad and infuriate sellers.</p>
<p>And why  is that? Because a genuine buying agent should be doing their best to  work exclusively in the buyer&#8217;s interests; and strangely enough, we&#8217;re  called buying agents, and if that isn&#8217;t a giveaway, I don&#8217;t know what  is.</p>

alt="" width="222" height="153" /></a>When you enter into a commercial lease, it is vital you  understand what is meant by irritancy. This is because it is a very  powerful weapon a landlord can adopt to evict a tenant who is breach of  their contractual obligations. So whatever your position (be it a  landlord or a tenant) you need to know how the irritancy process works,  what the law says, and whether or not you can rely upon legal  protection.</p>
<p><strong>What is Irritancy?</strong></p>
<p><em>Irritancy</em> is a common type of  eviction procedure that a landlord may use if a tenant is in breach of  the terms of the lease. It is similar to the English law of forfeiture,  although there are significant differences. In particular, under Scots  law it is easier for a landlord to enforce irritancy than it is for  their English counterparts to use forfeiture, as commercial tenants in  Scotland have very little legal protection.</p>
<p><strong>How Does Irritancy Work?</strong></p>
<p>A  landlord&#8217;s entitlement to employ the tool of irritancy will be set out  in the lease itself. This is because in <a href="http://www.scotlandrealestateagents.com" target=_self>Scotland</a>, the rights and  obligations of landlord and tenant are set out in the terms of the  lease, meaning each case will depend upon the contractual details. If  there is no specific clause relating to irritancy in the lease, a  landlord may only irritate the lease if a tenant has failed to pay rent  for two years.</p>
<p>Furthermore, the Law Reform (Miscellaneous  Provisions) (Scotland) Act 1985 does differentiate between monetary  breach and non-monetary breach. The type of breach that has occurred  will determine how irritancy may be used. We will look at each of these  in turn:-</p>
<p>1. <strong><em>Monetary breach.</em></strong></p>
<p>If a tenant has committed a  monetary breach (such as failing to pay rent in full and on time) then a  landlord may serve a pre-irritancy notice. This will be a written  record sent to the tenant stating how much they owe, and the date by  which the arrears must be paid. The tenant will then have a period of 14  days (or longer if stated in the lease) in which to meet the landlord&#8217;s  demands. If the tenant fails to do so, the lease may be irritated.</p>
<p>2. <strong><em>Non-monetary breach.</em></strong></p>
<p>On  the other hand, if there is a non-monetary breach (such as neglecting  to carry out maintenance works) a landlord will be unable to irritate  the lease if &#8220;in all the circumstances of the case a fair and reasonable  landlord would not seek to do so.&#8221; However, if it is fair and  reasonable to do so, a landlord will be able to serve a pre-irritancy  notice. Again, should a tenant fail to remedy the problem, the lease may  be irritated.</p>
<p>After the lease has been irritated, it is not  uncommon for a tenant to refuse to leave the premises. In such cases, a  landlord will need to obtain a court order stating the tenant must  vacate the commercial property.</p>
<p><strong>Does A Tenant Have Any Protection?</strong></p>
<p>The  introduction of the 1985 Act has given tenants some form of legal  protection. Prior to this piece of legislation, landlords were permitted  to exercise their right of irritancy without even giving a tenant time  to amend the situation. Now, however, there must be a period after the  pre-irritancy notice is served in which a tenant has the opportunity to  rectify the breach. Nevertheless, tenants remain particularly vulnerable  to irritancy, which is why it is prudent to obtain an expert opinion  from a solicitor.</p>
<p><strong><em>Seek Legal Advice.</em></strong></p>
<p>Whether you are a  landlord wanting to irritate a lease, or a tenant facing the threat of  irritancy, it is important your first step is to seek legal advice you  can trust. This is because you need to know where you stand, and what  action you can take next.</p>

<p><strong>What Are Sales Skills, Anyway?</strong></p>

I&#8217;ve almost unwittingly become an expert at selling to my  kids, partner, and friends in addition to my prospects. Surprisingly, as  often as I use these techniques, no one seems to catch on, and it  probably makes me a more agreeable person to be around.</p>
<p>Why?</p>
<p>Because  when selling, I do more listening than talking. I ask interesting  questions that others enjoy answering. I tell stories that relate to  what they&#8217;ve been talking about. I don&#8217;t go on and on about myself, my  product, or reasons they should agree with me.</p>
<p><strong>How Does that Work in Real Estate Prospecting?</strong></p>
<p>This  type of selling is often called consultative sales, or my own version,  called Openhanded Selling. In real estate prospecting, it means you&#8217;ll  use your influence to affect someone&#8217;s decision-making process. Not the  decision itself-just the process of making a decision. If that sounds  daunting, rest assured that it&#8217;s surprisingly easy to do once you  recognize the language patterns needed to direct a conversation. It&#8217;s  also subtle, supportive, and powerfully effective.</p>
<p>Many people are  attracted to consultative sales because they think of it as a &#8220;soft  sell&#8221; approach where they don&#8217;t have to ask someone to buy. But nothing  could be farther from the truth! Done correctly, this method is very  specific about what you want people to do-you want them to hire you as  their real estate agent.</p>
<p>In consultative sales-unlike traditional  benefits-driven selling-you don&#8217;t promote benefits for the entire first  half of your conversation. Instead, you&#8217;ll only present benefits after  you&#8217;ve asked interesting questions that your prospect has enjoyed  answering-questions about them and their situation that lead them  through a decision funnel. You listen thoroughly, and use your knowledge  of real estate business to ask further, even more perceptive questions  that help them make decisions.</p>
<p>You don&#8217;t try to force a decision down their throats. You take your time. Work around to the topic by &#8220;priming the pump.&#8221;</p>
<p><strong>How Does that Compare to Traditional Selling?</strong></p>
<p>Traditional real estate salespeople tend to do one of two things:</p>
<ol>
<li>They  ask a few &#8220;needs analysis&#8221; questions, get one or two answers, then  launch as quickly as possible into how they will fill those needs. Then  they talk and talk.</li>
<li>Or they get lost in the conversation. They start off one direction  (often casual, chatty), and don&#8217;t know how to turn it into a sales  conversation. That&#8217;s when they begin to substitute &#8220;education&#8221; for  selling, spending time explaining how buying or selling works and why  they&#8217;re a good choice, rather than finding out if and why the person  might be interested or not.</li>
</ol>
<p>If you know what I&#8217;m talking about, then you&#8217;re probably saying &#8220;OK, what can I do about it?&#8221;</p>

<p>Understand  how to begin a sales conversation and maintain control of it  consultatively. The frame of the interaction is yours to control.</p>
<p>If  you start the conversation one way, that&#8217;s the frame you&#8217;ve created.  Every question you ask controls the frame of the conversation. Don&#8217;t ask  questions that don&#8217;t move the conversation the direction you want it to  go.</p>
<p>If you find the conversation going the wrong way, then  recognize that there are certain questions you can ask that naturally  shift the frame. For instance, &#8220;What would happen if&#8230;?&#8221;</p>
<p><strong>How to Talk to Sellers about How to Do a Short Sale</strong></p>
<p>Here&#8217;s an example:</p>
<blockquote><p>Suppose  I&#8217;m talking to a teacher about being laid off and not being able to  find a new job. I think this teacher might have to do a short sale of  her home. She doesn&#8217;t want to think about short selling her home, does  she? Who does?So, rather than asking her directly about  whether or not she plans to sell her house, I want to be more subtle. I  can move the conversation in the right direction by saying something  like, &#8220;What would happen if you found a new job that paid a lot  less&#8230;would you take it?&#8221; And away we would go, talking about finances.</p>
<p>That  would eventually give me an opportunity to talk about how I helped  another person in her situation get a fresh start-and how that person is  better off now because he took advantage of the easy climate for  getting short sales approved.</p></blockquote>
<p>The framework  for a consultative sales conversation mirrors the framework of a  person&#8217;s decision-making process. In other words, if you want to sell  without seeming like you&#8217;re selling, you have to master the steps of the  decision-making framework, as well as a handful of influence techniques  for moving someone through that framework-naturally.</p>

<p>The  client financial worksheet normally can be a generic type sheet like the  one included in the appendix or occasionally the lender has their own  specific form. ASC which is the loan servicer for Wells Fargo is one of  these.</p>
<p>The financial worksheet gives the lender some idea of the  clients financial situation. If the worksheet shows that if they  tightened up their budget a notch, the owner actually could afford the  house, then the lender may offer a loan modification. If the worksheet  shows the owner cannot afford the house, the lender will go ahead and  (99.9% of the time) do a short sale. If the owner can probably head for  foreclosure if the owner refuses a loan mod. This is to take back the  property, file the deficiency judgment, and come after the homeowner for  the difference. The financial statement is very important to the  process and the numbers for expenses (groceries, utilities, cable,  water, autos, gas, etc.) should be in within reason. A lender will not  check the statements of expenses with a private investigator but if the  expenses seem unreasonably high, the lender will assume the homeowner is  being deceitful and may deny the short sale on those grounds. The  bottom line is that the outgo must exceed the income by a significant  amount. This is an amount that no reasonable budget restrictions can  overcome.</p>
<p><strong>2. The Authorization Letter</strong></p>
<p>The  authorization letter should include the sellers&#8217; full name, address of  the property, loan number, last four digits of the social security  numbers, full names printed and signed, and the people that the  authorization is for. This should include yourself, the name of the  closing agent at the title company that you will have open title on the  property, and anyone that is going to be calling the lender to work the  short sale. For example, an assistant or if you&#8217;re in an office that has  a &#8220;calling short sale lender person,&#8221; or if you decide to farm out  (outsource) the calling the lenders process, you would need the name of  that person or organization. You also should have the name of the real  estate company you&#8217;re working for with your cell, fax, and regular  office phone numbers as well as email address.</p>
<p>After the  authorization is faxed, you can work on getting a complete short sale  package put together while you&#8217;re waiting for an offer to come in on the  property. Some people will tell you that the order of the pages is  important but I think this is only true concerning a document like a  purchase offer. It is multiple pages and you really should take the  trouble to make sure page 2 follows page 1 and so on.</p>
<p><strong>3. The Hardship Letter</strong></p>
<p>Another  key factor that, strangely enough, is given a lot of weight by some  lenders and is not even considered by others is the Hardship Letter.  This is an explanation of hardship that is normally handwritten, signed,  and dated. The letter basically gives a reason or excuse to the lender  on exactly why they are late or totally unable to make their payments.  &#8220;My house isn&#8217;t worth what I paid for it&#8221; is not a valid excuse.  Reasonable and valid excuses are something along the lines of, divorce,  death, disaster, disease, destruction, and the main one lately is  de-employment. (loss of job)</p>
<p>The exception to the handwritten part  is when the owner&#8217;s handwritten part is when the owner&#8217;s handwriting is  totally ineligible or read with great difficulty, and illiteracy. The hardship letter must ALWAYS be signed and  dated no matter what form it&#8217;s written in.</p>
<p><strong>4. Two Most Recent Monthly Bank Statements</strong></p>
<p>The  2 most recent months&#8217; checking account is next on the list of documents  needed for the complete short sale package. This gives the lender an  idea of how much money is coming in and how much is going out and what  the money is going for and how much is accumulating. (if any) Just as  they wanted corroboration of the client financial sheet.</p>
<p><strong>5. Two Most Recent Pay Stubs</strong></p>
<p>When  you give copies to the lender of your 2 most recent pay stubs, this is  reinforcement again of the client financial statement. Take home monthly  income is stated on the financial sheet and it needs to match up pretty  closely with the pay stubs. Some homeowners are receiving unemployment  income. Even though this is temporary, the lender still wants that  income counted. With a regular paycheck that is direct deposited, the  employer also sends a paper trail to the employee stating how much money  was deposited and where it went. It is fine to include these statements  in lieu of actual pay stubs. If the unemployed have direct deposit they  are not sent a paper trail and have no proof of how much income is  directly. Indirectly, if the homeowner will circle the direct deposit  amounts on the 2 months bank statements with a notation about what it  is, that is acceptable.</p>
<p><strong>6. Last Two Years Tax Returns</strong></p>
<p>Now  for the final back up documentation of the client financial form, the  lender wants the last 2 years tax returns from the homeowner. Just one  year back is sufficient most of the time depending on what time of the  year it is. For documentation of documentation of documentation they  also ask that the W-2′s for the homeowner / employee be included. The  good news is that they really are only interested in the top 3 pages of  the tax return so you don&#8217;t have to send the entire return.</p>
<p>In the  case of the self &#8211; employed, the lender sometimes wants to see a profit  and loss statement for at least the past fiscal year and sometimes  likes to see the quarterly tax contributions. As an independent  contractor, we Realtors walk a fine line between employee and  independent business. The tax return and sometimes the lender will tell  you if they need additional information.</p>
